【Scope of Application of Terms of Service】
The Nomad SIM Service Terms of Use (hereinafter referred
to as the "Terms of Use") applies to all matters related
to the use of the data communication dedicated SIM
service and communication equipment rental service
(hereinafter referred to as the "Service") provided by
Nomad Works, Inc.
【Changes to the Terms of Use】
The Company reserves the right to change the Terms and
Conditions, including the contents of the Service,
without the consent of the applicant. Use of the Service
after such changes will be deemed acceptance of such
changes to the Terms of Service.
【Service Area】
This service area can be provided only when the terminal
equipment connected to the communication line is located
within the communication area of the agreed-upon service
provider. The subscriber may not claim any compensation
for damages due to the inability to perform
communications from us, except in cases where the
inability to perform communications is caused by our
intentional or gross negligence.
【Restriction on transfer of rights, etc.】
The right of the applicant to receive the Service under
these Terms and Conditions is non-transferable. The
Company may terminate the contract if the applicant
violates the preceding paragraph. The Company shall not
be liable for any loss or damage incurred by the
applicant as a result of such cancellation.
【Contract for this service】
An application for the use of this service (hereinafter
referred to as "Application") (hereinafter referred to
as "the Company") shall make an application for the use
of this service (hereinafter referred to as
"Application") by filling in the required information on
the online application screen on the Internet, after
agreeing to the Terms of Service and Important
Information in advance. The SIM card and
telecommunications equipment to be lent for the Service
shall be those designated by the Company. The Company
will not be able to respond to any request or request
for change by the applicant or subscriber. The contract
for the use of the Service shall be established when the
applicant completes the application for the Service in
accordance with the procedures designated by the Company
and when the Company approves the application. The
Company may not approve an applicant's application for
the Terms of Service if any of the following items
applies. In such a case, the Company will notify the
applicant to that effect.
-When there are reasonable grounds to believe that
the applicant may violate the Terms of Service.
-When there is a risk that the applicant may fail
to pay his/her obligations under the Terms and
Conditions.
-When the applicant has intentionally
misrepresented facts in the application form.
-When there is a risk that the applicant will use
the Service illegally or in a manner that is clearly
offensive to public order and morals
-When there
is a risk that the applicant will use the Service in a
manner that may damage the reputation of the Company or
the Service
-When the Company deems that it is
unable to provide the Service due to other
circumstances.
【Cancellation of application】
If you are unable to use this service due to
out-of-range signal conditions despite being within the
service area provided by a telecommunications carrier or
an agreed-upon service provider, the subscription will
be cancelled if you notify us within 7 days of the date
of application. (We will refund the amount of the
cancellation fee, excluding the administrative fee.) If
more than 8 days have elapsed since the application, the
cancellation request cannot be accepted under any
circumstances.
【Delivery of SIM cards and telecommunications
equipment】
The subscriber may take delivery of the SIM card and
telecommunications equipment from the Company or a
business operator designated by the Company at a
designated location after the conclusion of the
contract. The subscriber is not allowed to cancel the
subscription agreement after delivery of the SIM card
and communication equipment. In the event of delay or
inability to deliver, the Company shall be solely
responsible for delivering substitute equipment, and
shall assume no other responsibility.
【Management of SIM cards and telecommunications
equipment】
The subscriber shall be obligated to maintain and manage
the SIM card and communication equipment with the due
care of a good manager. If the Company deems that the
Subscriber's conduct constitutes prohibited conduct, the
Company may recommend that the Subscriber cancel the
contract and return the SIM card and communications
equipment for data communications only, and the
Subscriber must comply with such recommendation. Any and
all acts performed with respect to the SIM card and
telecommunications equipment while on loan shall be
deemed to be those of the Subscriber. The Subscriber is
prohibited from the following acts when using the SIM
card and telecommunications equipment. If the Subscriber
violates this prohibition, the Subscriber shall be
obligated to pay compensation for damages, which may
result in termination of the usage contract. Transfer,
resale, analysis, modification, alteration, damage,
destruction, loss, significant defacement (sticker
attachment, cutting, coloring, etc.), removal of
attached stickers, etc. of the SIM card or communication
equipment
Unauthorized use outside of these Terms and
Conditions
Actions that fall under the prohibited
items described in the instruction manuals for SIM
cards, telecommunications equipment, etc. Violation of
the Telecommunications Business Law, the Mobile Phone
Improper Use Prevention Law, and other related laws and
regulations In the event that the SIM card or
telecommunications equipment is lost, damaged, or
stolen, the subscriber shall be obligated to immediately
notify the Company to that effect. If the SIM card or
telecommunications equipment is lost or damaged, the
subscriber shall be obligated to pay for the repair or
replacement of the SIM card or telecommunications
equipment, unless the reason for the loss or damage is
attributable to the Company.
【Purchase of SIM cards and telecommunications
equipment】
Applicants are not permitted to purchase SIM cards or
telecommunications equipment without the Company's
approval.
【Service Details】
The contents of the Service to be provided by MJS shall
pertain to the matters listed in the following items.
-Provision of communications for the Service
-Loan of the SIM card and communication equipment
necessary for the use of this service.
-Arrangement of alternative data communication SIM
cards and alternative communication devices in case of
initial failure of the SIM card or communication
devices.
-Other matters incidental to each of the
preceding items.
【Change of service content】
The Company reserves the right to change the usage fees
and service content of the Service without the consent
of the subscriber. In addition, SBM may change the usage
fees and service contents of the Service without the
consent of the subscriber due to the influence of social
conditions or changes made by telecommunication
providers.
【SIM card rental】
We will lend a SIM card to the subscriber of this
service. The SIM card lent by the Company will be a data
communication-only SIM card. The loaned SIM card
includes all of the cards, including standard SIM
(U-SIM), microSIM, and nanoSIM, which are put together
respectively when sent. We will send the SIM card at the
location specified as the mailing address information.
【Rental of terminal equipment】
The Company will lend a set of rental terminal to the
subscriber of this service. The rental terminal set
consists of JT101 + SIM + dedicated box + MicroUSB
cable. The Company will send the rental terminal set at
the location specified in the shipping address
information.
【Return of SIM card/terminal equipment】
The SIM card/terminals for this service are rental
items. If the handset is not returned by the due date,
if it is found to be broken or damaged upon return, or
if the following rental set of handsets is missing, the
customer shall pay the Company an equipment damage fee.
【Rental SIM card set】
The SIM card/terminals for this service are rental
items. If the handset is not returned by the due date,

rental terminals to be rented by the Company when there
are unavoidable reasons for technical or business
reasons. In the following cases, the applicant shall
promptly return a set of rental terminals to the Service
Handling Office in the manner prescribed by the Company.
In such cases, SOFTBANK TELECOM will notify the
applicant in advance.
(1) When the contract for
the Service pertaining to the rental of the set of
rental terminals is cancelled.
(2) When the
applicant no longer uses the rental terminal set. (3)
When the Company changes the rental terminal set, the
applicant shall return the rental terminal set before
the change. If the Applicant does not return the Rental
Terminals, the Applicant shall pay to the Company the
amount of the Monthly Charges corresponding to the
elapsed period. The Applicant shall manage the rental
terminal set with the care of a good manager. The
Applicant shall promptly notify the Company of any
theft, loss or damage of the Rental Terminals. Even if a
third party uses the rental terminal set, the Company
shall treat it as if the rental terminal set had been
used by the applicant who has been lent the rental
terminal set. The Company shall not be liable for any
damage caused by theft, loss, or damage of the rental
terminal set.
【Initial failure of the terminal equipment】
f there is a possibility of an initial defect in the
equipment, please contact our support center as soon as
possible within 8 days of the start date of the
contract. If we confirm that the equipment is initially
defective, we will replace it with a new one. If you do
not contact our Support Center within 8 days of the
contract start date, we may not be able to replace the
equipment based on the initial defect. (The equipment
will be repaired in the same way as normal defective
equipment.) In the event that the equipment is replaced
due to initial failure, the equipment must be shipped to
the designated contact point. The cost of shipping is
the responsibility of the applicant. In the event that
the equipment is replaced due to an initial malfunction,
the service fee will not be refunded or reduced during
the period when the service is unavailable.
【Replacement or Repair in the Event of Terminal
Equipment Failure】
There is no warranty against malfunction or damage for
more than 8 days from the start date of the contract.
Please note that any charges for repair or replacement
will be borne by the applicant. (*Except for initial
defects. As with the initial failure, no refunds or
exemptions will be granted for the period of inactivity.
【Restrictions on use】
In order to provide fair and equitable
telecommunications usage, SBM may suspend or restrict
the use of SIM cards and telecommunications equipment
when an applicant or user engages in excessive
communications, based on policies by the
telecommunications carriers that provide such services
or at SBM's discretion.
【Fees and payment methods】
Fees for this service shall be calculated based on the
amount set forth on our website. Fees are subject to
change during campaign periods and for large volume
applications.
The applicant shall be obligated to pay the fee
for the Service to the Company.
Fees for this
service shall accrue during the usage period, regardless
of whether or not actual communications are made.
Fees are due on the first day of the current
month, and payment can be made by credit card.
If
the applicant does not pay the fee by the payment due
date designated by the Company, the applicant shall be
obligated to pay the Company late interest at the rate
of 14.5% per annum.
The Company may entrust the
act of billing and receiving claims against the
Applicant under these Terms and Conditions to a third
party.

【Damages】
In the event that the applicant causes damage to the
Company due to reasons attributable to the applicant in
connection with the use of the Service, the applicant
shall be obligated to compensate the Company for the
damage suffered by the Company. If the applicant causes
damage to a third party or has a dispute with a third
party in connection with the use of the Service, the
applicant shall settle the dispute at his/her own
responsibility and expense, and shall not hold the
Company liable for any damage. In the unlikely event
that the Company is held liable by another applicant or
a third party, the applicant shall resolve the dispute
at his/her own responsibility and expense, and the
Company shall be exempt from any and all liability.
【Rebilling of charges】
In the event that the applicant has not paid the fees
and other obligations after the due date as determined
by the Company, the Company shall rebill the applicant
for the fees. We may outsource the re-invoicing to a
third party. In such cases, the subscriber shall bear
the costs incurred.
【About the security deposit.】
A security deposit of up to 22,000 yen/unit (tax
included) may be required depending on the screening
status and non-return of the rental terminal equipment.
Please note that the security deposit will be applied to
any unpaid invoices. Invoices, receipts, etc. Paper
invoices and receipts will not be issued. However, we
may issue an invoice at our discretion in cases where we
are unable to contact the applicant for an extended
period of time.
Support and billing services are outsourced and
credits are transferred.
In the following cases,
the applicant may be required to deposit a security
deposit prior to use of the service.
(1) When the
application for a membership contract is accepted.
(2) When an application for a fee contract has
been accepted.
(3) When the suspension of service
is lifted after the suspension.
The amount of the
deposit shall be determined separately by the Company.
The security deposit shall bear no interest. (4) When
the reason for which the security deposit was deposited,
such as termination of the membership contract, is
resolved, the Company shall return the security deposit
for the contract to the depositor. When returning the
security deposit, if there is any amount owed by the
applicant under the contract, the Company shall apply
the amount returned to such amount. In the event that
the applicant fails to pay the charges and other debts
demanded by the debt collection agency after the due
date, and the applicant has deposited a security deposit
with the Company, the Company shall repurchase the
deposit (if the amount is larger than the security
deposit, the amount shall be the same as the security
deposit) from the debt collection agency and return it
to the applicant. ) from a debt collection agency and
apply the security deposit to such amount.
A
demand fee of 330 yen (including tax) shall be charged
for each invoice issued.
【Assignment of these Terms and Conditions】
In the event that the Company transfers the business
related to the Service to another company, the Company
may transfer the status of the Subscriber, rights and
obligations under the Terms of Service, and the
Subscriber's registration information and other customer
information to the transferee of such business transfer,
and the Subscriber agrees to such transfer in advance in
this paragraph. The applicant shall be deemed to have
agreed in advance to such transfer in this paragraph.
The business transfer stipulated in this paragraph shall
include not only ordinary business transfers, but also
company splits and any other cases in which the business
is transferred.
【Personal Information Protection】
In accordance with the provisions of the Act on the
Protection of Personal Information, the Company shall
properly manage the personal information of applicants
with the care of a good manager. The Company shall use
the applicant's personal information for the purpose of
providing services (such as product and service
announcements, implementation of surveys, etc.),
billing, or informing the applicant of services offered
by the Company group, and shall not use it for any other
purpose. Applicants are required to register as members
in order to use the service. Members may be contacted
individually or collectively, as necessary, through
notification methods (e-mail, telephone, postal mail,
etc.) determined by the Company to the registered
contact address.
【Governing Law and Jurisdiction】
These Terms of Use shall be governed by and construed in
accordance with the laws of Japan. The Tokyo District
Court shall have exclusive jurisdiction in the first
instance over any disputes related to these Terms of Use
or related matters.
